I got told because of my mental health I won’t get a supervisor position at work. Though I can have a less stressful job with same pay. I’m torn because the one position I really want is being offered. Yet I feel offended but she’s probably right about being able to supervise people. Ugh I’m so conflicted. How would you feel if you got told your mental health is a reason for not getting promoted?

That’s complete bs that you were told no. It’s against so many ethics and law. I’d get a lawyer

I need my job and it’s my word against hers if I pursued it I think

I’d ask them about THEIR mental health.

She said she struggles with anxiety but with my history which I assume was my time in the psych hospital she just felt it would be too stressful.

That’s such an obvious case of discrimination and definitely shouldn’t be allowed. The only person who can make the judgement call regarding your mental health is you.

I agree with the others that is just wrong and should of never been said. That opens them up to so many legal problems if you wanted to pursue it. I wouldn’t blame you if you did.

I know how that is. Always in your pocket for later if you ever need it.

It’s against the law, isn’t it? Do you have it in writing? HR department or small office? It makes me so mad I want to come into your office and scream at them for you ! Geez!!!

No it was verbal. And I’m pretty sure bipolar is protected here in USA by the American disability act but not positive. It’s always listed under the questions for hire do you have one of these disabilities.

Such BS! I think it’s covered under the ADA. I know it’s still scary to take it forward. What will you do?

I’m going to see if I get other promotion.

I’d point out the ADA and call local legal aid. Not ok. Shame you didn’t have the conversation recorded…

I would feel conflicted. On the one hand, I know my mental health can have times where it effects how and what I can do sometimes– but I wouldn’t like it being said to me. I think I would dip low for a little bit at the reality and wishing it were different.

However, on the other hand… I would be thrilled that they thought enough of me to offer me a LESS stressful position for the SAME pay. I would take that as a reflection that they truly appreciate me and want to keep me around at what I can do to be of best benefit for a win-win situation.
Best of luck. I’ll be thinking of you.

I have. I quit because that is a form of discrimination. That’s why I use a handle online too. You are more than capable of being a supervisor.

That’s not for her to judge. Not even for a second.

that’s bloody awful hun! I’d be taking some action! Going for legal advice! She has no right to do this to you!
